Award Compliance

Make sure that you are getting advice on your Award obligations from an employment law expert.  Awards are legal documents and there are serious legal consequences if you get it wrong.

We have advised hundreds of employers on their Award obligations, from small businesses with a couple of employees, right through to national employers with thousands of employees.

Our clients have relied on our advice and award interpretation in cases where the flow on effect of getting it wrong would have been in the millions of dollars.

We can advise on all aspects of Award interpretation and compliance, including correct Award application, employee classifications, individual flexibility agreements and ways to contractually vary the application of certain Award terms.

Our focus is on ensuring that you can get on with doing business, knowing that all of the legal compliance boxes are ticked.

Award advice for new businesses

If you are opening a new business, you may be not quite sure where to start when working out which Awards and minimum entitlements will apply to your employees.

We can assist you with getting things sorted in the simplest and most appropriate way for your business and make sure that you have everything in place right from the start.

Underpayment claims and Fair Work Ombudsman investigations

Employees who have been underpaid can make claims for up to six years’ backpay.  If the Fair Work Ombudsman gets involved in an individual underpayment claim it might trigger a much wider investigation into your pay practices and unearth other underpayment claims.

Get some advice as soon as possible if you think that there is any chance that you have inadvertently been underpaying your employees.

Directors, Managers and HR professionals all face potential personal liability for underpayments and it is vitally important that you exercise extreme caution in these cases.

We can advise on all underpayment issues, including representing your interests if the Fair Work Ombudsman gets involved.

The role of employment contracts in Award compliance

Properly drafted employment contracts are an important part of ensuring that your business is Award compliant.

For example, many employers do not realise that they cannot simply pay Award employees a salary unless they have the employee’s agreement to specific terms and conditions and conduct regular checks against Award obligations.

Many extremely large businesses have found this out the hard way in recent years.

We help employers solve and prevent people issues. We are problem solvers.
